Minutes of March 4th, 2009 approved as amended.

Steiner (20-24)  Chris Alley presented a proposal for construction of a seven-bedroom disposal system to serve an existing five-bedroom house.  He reported that the owner wishes to install a swimming pool in close proximity to the existing 2,000 gallon septic tank, which will be abandoned, pumped, and removed from the swimming pool site.  The upgraded system will use a 2,000 gallon tank.

Having satisfied itself that the minimum setback distances of 10ft separation between the swimming pool and septic tank, and the 20ft separation between the swimming pool and leaching field were met, and that the proposal was Title 5 compliant, the Board approved the proposed disposal system contruction permit.

Street (14-19.1)  The Board agreed that the certificate of compliance can be issued, as an as-built letter from engineer Frank Daly was received by the Board at its January 21st, 2009 meeting, confirming that BOH conditions have been met.
Bernstein (27.1-166) HEARING 5:15 pm:   George Sourati (Sourati Engineering Group) demonstrated that abutters have been notified within the timeframe specified by Title 5 regarding variances sought for the above property. Green cards have been received on all but three: Morgan, Poole and Good.  No correspondence regarding this hearing has been received by the BOH.
George Sourati reported on a proposed upgrade of the septic system of a four bedroom house (one bedroom of which is detached).  The year-round residence is on a small (9,111 ft2) lot which also includes an existing well.
While distance to salt marsh and distance to groundwater limits can be attained, the plan requires variances.  Title 5 variances are reduction in distance between the soil absorption system to the well from 100’ to 51’, and reduction in the distance from a soil absorption system to the cellar wall from 20’ to 13’.  Chilmark BOH regulation variances will be required to reduce the required distances 1) from leaching system to well from 150’ to 51’; 2) from leaching system to property line from 30’ to 10’ and 25’; 3) from leaching system to cellar wall from 20’ to 13’; 4) from leaching system to neighboring leaching facilities to less than 300’; and 5) from a leaching system to a watercourse (wetland) from 150’ to 106’.
The BOH approved the proposal as presented with the following conditions:
-       a letter from the owners acknowledging their awareness that the 51’ separation between the soil absorption system and the drinking water well does not meet Title 5 and Chilmark requirements;
-       owners agree that there will be no expansion of use, no increase in number of bedrooms, and no change in footprint of the dwelling while the current drinking water well is serving the property;
-       drinking water will be tested 3x per year, once in the height of the summer season.  Owners may reappear before the Board if all tests were negative during the first year to consider easing testing requirements for future years.
Marina Lent will send a letter outlining the approval described above to George Sourati.

Middle Line Road Project (13-43) Ten well permit applications for the Middle Line Road affordable housing project were reviewed by the Board.  The Board noted that the locations of the proposed wells were not marked on the sketches accompanying the well permit applications, nor were distances indicated.  Disposal Works proposals submitted in August 2008 did reflect separations, but lot and site identification numbers were inconsistent. The Board would like to have well proposals submitted with the well permit applications which clearly identify the parcels by Map and Lot number as assigned by the Chilmark Board of Assessors.

Chilmark Store (30-85)  The Board reviewed a service/maintenance report from Clivus New England, Inc. for servicing of the composting and greywater system at the Chilmark Store performed in December 2008. The Board requested Marina Lent to follow up with Clivus on elements of the report.

Menemsha Comfort Station (21-1)  Kent Healy reported that water use at the Menemsha Comfort Station reaches a peak of 3,000 gallons per day in the summer, and that the disposal system needs to be expanded to avert impending failure. Kent Healy presented a proposal to install 3x6 leaching chambers (531ft2) to expand leaching capacity by 15% for the existing system of 1,500 and 750 gallon septic tanks with a Pirana Alternative Treatment System and a 700ft2 leaching bed.  Katie Carroll suggested that no-flush urinals could be installed, and Mike Renahan pointed out that an entirely new system will eventually become inevitable.  Mike also asked that, while the upgrade is undertaken, all components of the system be inspected.  The Board approved the proposed upgrade.

Hyde (26-66)  Kent Healy conveyed a request from Robin Hyde for Board of Health approval of a 6-bedroom septic system that was installed more than 10 years ago without a valid permit.  The Board instructed Mr. Hyde to start the application process from the beginning, and to apply for a permit with an approved plan detailing what has been installed, which shows that the system is built to new Title 5 specifications.

Food Establishment Inspections done: Beach Plum Inn  

Installer’s Permit application received:  M.V. Peters Excavation.  The Board asked Marina Lent to inquire with the insurance company regarding provision for 10 day notice of cancellation for non payment of premium.

Updating BOH Regulations:   Marina Lent will find out whether the BOH can submit draft Coastal District Separation regulations to the upcoming Town Meeting in April for approval.  Marina Lent will also review existing BOH Regulations and bring proposed updates to the Board for review.

Roglieri (25-116)  Oil spill RTN# 4-21638:  Marina Lent reported on her inquiries regarding a spill of #2 heating oil during the removal of an underground storage tank. The Immediate Response Action plan submitted by the owner states that 20 cubic yards of contaminated soil will be removed for re-use, recycling or treatment at the Aggregate Industries in Stoughton, MA.

Staff scheduling:  Marina Lent’s scheduled working hours are 8:30am to 2:30pm Monday-Friday.  She will ensure that notification is left with front desk, posted on the door, and on the answering machine when work-related duties require her absence from her desk during these hours. (Exception is made for emergent ambulance calls).

Beach Testing: The Board asked Marina Lent to determine who has been collecting test samples, and who is paying for the testing done from the Department of Public Health Environmental Toxicology Program’s marine testing sites at Land Bank-managed beaches on Abel’s Hill and Great Rock Bight.

Burn Permits:  The Board took note of DEP approved prescribed burn permits for the Nature Conservancy to conduct prescribed burns at locations in Chilmark during the 2009 season.
Beach Plum Inn (21-70)  The Board took note of the ZBA decision on Beach Plum Inn, approving conversion of the first floor of the garage into a common area for Inn guests and rebuilding the existing kitchen; conversion of the second floor of the garage into a one-bedroom suite with bathroom to rent for overnight guests at the Inn; elimination of one of the existing two bedrooms in a separate guest cottage, which means that there will be no expansion in the Inn’s overnight guest capacity as a result of the proposed changes.  The guest capacity remains at 11 rooms for 22 overnight guests.

Landfill mowing A proposal for the cost of $575.00 for landfill mowing during the month of June was submitted by the Martha’s Vineyard Refuse District.  Marina Lent was asked to confirm that we have sufficient funding in the FY’09 budget to approve this proposal.

Dukes County Integrated Pest Management Marina Lent was asked to review invoices of $633 for mosquito trapping in the summer of 2009 and $23.21 for the construction of mosquito resting boxes for the summer 2009 trapping season to determine whether these are to be paid out of funds pledged by the BOH for FY’09 for the mosquito trapping program, or whether these invoices should be paid out of FY’10’s BOS budget line item for the mosquito trapping program.
